{"id":340,"date":"2023-01-11T16:49:32","date_gmt":"2023-01-11T16:49:32","guid":{"rendered":"https:\/\/canadianbenefits.com\/?page_id=340"},"modified":"2023-03-17T19:02:05","modified_gmt":"2023-03-17T19:02:05","slug":"privacy-policy","status":"publish","type":"post","link":"https:\/\/www.canadianbenefits.com\/?p=340","title":{"rendered":"Privacy"},"content":{"rendered":"\n<p class=\"gtfy-1 wp-block-paragraph\">NEXGENRX PRIVACY POLICY<\/p>\n\n\n\n<h3 class=\"wp-block-heading gtfy-4\">Purpose:<\/h3>\n\n\n\n<p class=\"gtfy-7 wp-block-paragraph\"><img width=\\\"2\\\" height=\\\"17\\\" src=\\\"\\\">NexgenRx\u2122 Inc. and its subsidiaries, affiliates and related entities (NexgenRx, MyBenetech and Canadian Benefit Administrators) is committed to protecting the privacy of individuals and ensuring the security of their personal health information. NexgenRX is a prescribed entity under Section 45 of the Ontario Personal Health Information Protection Act (PHIPA) <a href=\\\"https:\/\/www.ontario.ca\/laws\/statute\/04p03#BK63\\\">(PHIPA S.45)<\/a> and is authorized to collect personal health information for the purpose of benefit claims adjudication, payment processing and reporting for Clients, Providers and Members or compiling statistical information with respect to the management, evaluation or monitoring of the benefit support services provided by the Benefit Management System (BMS). NexgenRx has implemented policies, procedures and practices to protect the privacy of individuals whose personal health information it receives and to maintain the confidentiality of that information. As a prescribed entity, NexgenRx is subject to independent oversight by the Ontario Information and Privacy Commissioner and must have its information practices reviewed and approved by the Commissioner every 3 years <a href=\\\"https:\/\/www.ipc.on.ca\/decisions\/three-year-reviews-and-approvals\/three-year-review-and-approval-process\/\\\">(IPC Approval Process)<\/a> . This review process provides the Canadian public with the assurance that NexgenRx\u2019s information management practices comply with PHIPA and with privacy and security standard practices expected from the Commissioner. As a result, NexgenRx adheres to the provisions of PHIPA and its regulations applicable to prescribed entities and to any other applicable privacy legislation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading gtfy-10\"><a><\/a>Commitment to Privacy &amp; Security:<\/h3>\n\n\n\n<p class=\"gtfy-13 wp-block-paragraph\">NexgenRx is committed to safeguarding its IT ecosystem, to securing its data holdings and to protecting health information with administrative, physical and technical security safeguards, appropriate to the sensitivity of the information. These safeguards protect NexgenRx\u2019s data holdings against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. To this end, NexgenRx has developed a privacy and security framework as outlined in this policy that provides a coherent and comprehensive approach to enterprise privacy and security management. This policy is designed to enable the effective integration and coordination of NexgenRx\u2019s privacy and security policies, and to provide NexgenRx\u2019s decision- makers, information and privacy officer and the entire governance structure with a holistic view of the organization\u2019s information management practices. It is intended to be a living document and is updated as NexgenRx\u2019s Information and Privacy programs evolve over time.<\/p>\n\n\n\n<p class=\"gtfy-16 wp-block-paragraph\">NexgenRx is committed to the principle of openness about the management of personal health information and de- identified data. As such, NexgenRx makes its Privacy Policy publicly available.<\/p>\n\n\n\n<h3 class=\"wp-block-heading gtfy-19\"><a><\/a>Compliance, Audit and Enforcement:<\/h3>\n\n\n\n<p class=\"gtfy-22 wp-block-paragraph\">The NexgenRx Code of Conduct describes the ethical and professional behaviour related to work relationships, information<\/p>\n\n\n\n<p class=\"gtfy-25 wp-block-paragraph\"><img width=\\\"2\\\" height=\\\"17\\\" src=\\\"\\\">\u2014 including personal health information \u2014 and the workplace. The code requires all employees to comply with the code and with all of NexgenRx\u2019s policies, protocols and procedures, including this Privacy Policy. Compliance with NexgenRx\u2019s Privacy Program is monitored through NexgenRx\u2019s privacy audit procedures. Violations of the code are referred to Human Resources, as appropriate, and may result in disciplinary action up to and including dismissal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading gtfy-28\"><img width=\\\"2\\\" height=\\\"17\\\" src=\\\"\\\"><a><\/a>Notification of breach:<\/h3>\n\n\n\n<p class=\"gtfy-31 wp-block-paragraph\">Instances of non-compliance with privacy policies are managed through the office of the Information and Privacy Officer. Non-compliance requires staff to immediately report incidents and breaches to NexgenRx\u2019 Information and Privacy Officer, including non- compliance with this policy or its procedures.<\/p>\n\n\n\n<h3 class=\"wp-block-heading gtfy-34\"><a><\/a>Policy objective:<\/h3>\n\n\n\n<p class=\"gtfy-37 wp-block-paragraph\">The purpose of this policy is to protect the privacy of the personal information of the plan members of the Canadian based plan sponsors whose benefits plans we administer and ensure that personal health information and encrypted data resulting from personal health information are collected, used, disclosed, retained and disposed of in a manner consistent with this policy<\/p>\n\n\n\n<p class=\"gtfy-40 wp-block-paragraph\">and in accordance with applicable laws and agreements.<\/p>\n\n\n\n<h3 class=\"wp-block-heading gtfy-43\"><a><\/a>Definitions:<\/h3>\n\n\n\n<p class=\"gtfy-46 wp-block-paragraph\"><strong><em>\u201cPIPEDA\u201d: <\/em><\/strong>The Personal Information Protection and Electronic Documents Act S.C. 2000, c.5 as amended from time to time.<\/p>\n\n\n\n<p class=\"gtfy-49 wp-block-paragraph\"><strong><em>\u201cPHIPA\u201d: <\/em><\/strong>The Ontario Personal Health Information Protection Act as amended from time to time. <strong><em>\u201cFIPPA\u201d: <\/em><\/strong>Freedom of Information and Protection of Privacy Act as amended from time to time. <strong><em>\u201cPHI\u201d: <\/em><\/strong>Personal Health Information.<\/p>\n\n\n\n<p class=\"gtfy-52 wp-block-paragraph\"><strong><em>\u201cPI\u201d:<\/em><\/strong><strong><em> <\/em><\/strong>Personal Information.<\/p>\n\n\n\n<p class=\"gtfy-55 wp-block-paragraph\"><strong><em>\u201cCommercial Activity\u201d: <\/em><\/strong>any particular transaction, act, or conduct or any regular course of conduct that is of a commercial character, including the selling, bartering, or leasing of individual, membership, or other personal information.<\/p>\n\n\n\n<p class=\"gtfy-58 wp-block-paragraph\"><strong><em>\u201cElectronic Devices and Media\u201d<\/em><\/strong>: USB, computers, photocopiers, scanners, tablets, diskettes, tapes, hard drives, thumb or jump drives, phones, and all other moveable or removable devices and media that may be used for the use, disclosure, or storage of Personal Information (PI) or Personal Health Information (PHI).<\/p>\n\n\n\n<p class=\"gtfy-61 wp-block-paragraph\"><strong><em>\u201cInformation Manager\u201d: <\/em><\/strong>an individual, corporate organization, business, or association that processes, stores, or destroys PI or PHI, or provides information management or information technology services to or on behalf of NexgenRx.<\/p>\n\n\n\n<p class=\"gtfy-64 wp-block-paragraph\"><strong><em>\u201cIntegrity\u201d: <\/em><\/strong>the preservation of the content of PI or PHI throughout its storage, use, transfer, and retrieval so that there is confidence that the information has not been tampered with or modified other than as authorized.<\/p>\n\n\n\n<p class=\"gtfy-67 wp-block-paragraph\"><strong><em>\u201cPrivacy Breach\u201d: <\/em><\/strong>the collection, use, disclosure, or destruction of PI or PHI in contravention of FIPPA, or PIPEDA.<\/p>\n\n\n\n<p class=\"gtfy-70 wp-block-paragraph\"><img width=\\\"2\\\" height=\\\"18\\\" src=\\\"\\\"><strong><em>\u201cResponsible<\/em><\/strong><strong><em> <\/em><\/strong><strong><em>Administrator\u201d:<\/em><\/strong><strong><em> <\/em><\/strong>Information and Privacy Officer<\/p>\n\n\n\n<p class=\"gtfy-73 wp-block-paragraph\"><strong><em>\u201cSecured Place\u201d<\/em><\/strong>: a physical environment for the temporary or permanent storage of, or for the use, processing, or communication of PI or PHI which physical environment has the following characteristics:<\/p>\n\n\n\n<ul class=\"wp-block-list gtfy-81\">\n<li class=\"gtfy-76 gutenify-list-item\">is readily accessible to only authorized persons,<\/li>\n\n\n\n<li class=\"gtfy-77 gutenify-list-item\">is keyed or otherwise locked to allow entrance or access to authorized persons only<\/li>\n\n\n\n<li class=\"gtfy-78 gutenify-list-item\">is protected by controls to protect against theft, vandalism, or accidental destruction or loss<\/li>\n\n\n\n<li class=\"gtfy-79 gutenify-list-item\">is protected by controls to minimize loss, destruction, or deterioration caused by fire, water, humidity, or other hazards, and<\/li>\n\n\n\n<li class=\"gtfy-80 gutenify-list-item\">has proper containers and adequate labelling to reduce accidental loss or destruction.<\/li>\n<\/ul>\n\n\n\n<p class=\"gtfy-84 wp-block-paragraph\"><strong><em>\u201cSocial Media\u201d: <\/em><\/strong>websites and digital applications that enable users to create and share information, ideas, and similar content and create connections.<\/p>\n\n\n\n<h2 class=\"wp-block-heading gtfy-87\"><a><\/a>COMMON REQUIREMENTS IN RESPECT OF PERSONAL INFORMATION AND PERSONAL HEALTH INFORMATION<\/h2>\n\n\n\n<h3 class=\"wp-block-heading gtfy-90\"><a><\/a>Collection of Personal or Personal Health Information<\/h3>\n\n\n\n<p class=\"gtfy-93 wp-block-paragraph\">NexgenRx only collects from data providers, personal health information and data that is reasonably required for health system uses, including claims processing, audit and reporting.<\/p>\n\n\n\n<ol class=\"wp-block-list gtfy-106\" type=\\\"1\\\">\n<li class=\"gtfy-96 gutenify-list-item\">Only authorized persons may collect PI or PHI.<\/li>\n\n\n\n<li class=\"gtfy-97 gutenify-list-item\">Collection must be authorized by a statute or alternatively where the information collected relates directly and is necessary for an existing service, program, or activity of NexgenRx.<\/li>\n\n\n\n<li class=\"gtfy-98 gutenify-list-item\">PI or PHI shall be collected in a manner and location that ensures the security, accuracy, integrity, and confidentiality of the information, to the extent that it is reasonable to do so.<\/li>\n\n\n\n<li class=\"gtfy-99 gutenify-list-item\">Collection shall be limited to only as much PI or PHI as is reasonably necessary to accomplish the purpose for which it is being collected, and that a reasonable person would consider appropriate in the circumstances.<\/li>\n\n\n\n<li class=\"gtfy-100 gutenify-list-item\">Whenever possible, PI or PHI shall be collected directly from the individual to whom the information relates, unless a method of indirect collection authorized under FIPPA is necessary.<\/li>\n\n\n\n<li class=\"gtfy-101 gutenify-list-item\">If collecting PI or PHI directly from the individual to whom the information relates, he or she shall be provided with the purpose and the contact information of a NexgenRx employee who can answer questions about the collection, unless the company has recently provided the individual with this information about the collection of the same or similar PI or PHI for the same or a related purpose.<\/li>\n\n\n\n<li class=\"gtfy-102 gutenify-list-item\">If collecting PI directly from the individual to whom the information relates, the individual shall also be provided with the legal authority under which the information is collected, unless NexgenRx has recently provided the individual with this same information about the collection of the same or similar PI for the same or a related purpose.<\/li>\n\n\n\n<li class=\"gtfy-105 gutenify-list-item\">If collecting PI or PHI in the course of commercial activity, the consent of the individual to whom the information relates is required, unless;<ol><li>collection without consent is permitted under sections 7 to 7.4 of PIPEDA (PIPEDA S.7)<\/li><\/ol><ol><li>it is impossible or impractical to seek consent, or<\/li><\/ol>\n<ol class=\"wp-block-list gtfy-104\">\n<li class=\"gtfy-103 gutenify-list-item\">the PI or PHI is not sensitive and the individual to whom the information relates would reasonably expect that consent is implied.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-109\"><a><\/a>Access to Personal or Personal Health Information<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-121\" type=\\\"1\\\">\n<li class=\"gtfy-112 gutenify-list-item\">Only authorized persons may use and disclose PI or PHI and only as required for the purpose for which it was collected or disclosed unless the individual to whom the information relates has provided consent for other use or disclosure or use or disclosure is otherwise authorized under FIPPA.<\/li>\n\n\n\n<li class=\"gtfy-113 gutenify-list-item\">PI may be used or disclosed for a consistent purpose in accordance with s.45 of FIPPA. <a href=\\\"https:\/\/www.ontario.ca\/laws\/statute\/90f31#BK69\\\">(FIPPA S.45)<\/a><\/li>\n\n\n\n<li class=\"gtfy-114 gutenify-list-item\">The use and disclosure of PI or PHI shall be in a manner and location that ensures the security, accuracy, integrity, and confidentiality of the information, to the extent that it is reasonable to do so.<\/li>\n\n\n\n<li class=\"gtfy-115 gutenify-list-item\">The use and disclosure of PI or PHI shall be limited to the minimum amount of information necessary to accomplish the purpose for which the information is used or disclosed and that a reasonable person would consider appropriate in the circumstances.<\/li>\n\n\n\n<li class=\"gtfy-116 gutenify-list-item\">The use and disclosure of PI or PHI shall be limited to the fewest persons necessary to carry out the purpose for which the information is used or disclosed.<\/li>\n\n\n\n<li class=\"gtfy-117 gutenify-list-item\">PI or PHI shall not be disclosed to any person, unless the individual to whom the information relates has provided consent for the disclosure, or disclosure is otherwise authorized under FIPPA.<\/li>\n\n\n\n<li class=\"gtfy-118 gutenify-list-item\">Before using or disclosing PI or PHI, authorized persons shall take reasonable steps to ensure that the information is accurate, up-to-date, complete, and not misleading.<\/li>\n\n\n\n<li class=\"gtfy-119 gutenify-list-item\">Disclosure to an information manager may only be made as permitted under FIPPA.<\/li>\n\n\n\n<li class=\"gtfy-120 gutenify-list-item\">If using or disclosing PI or PHI in the course of commercial activity, the consent of the individual to whom the<\/li>\n<\/ol>\n\n\n\n<p class=\"gtfy-124 wp-block-paragraph\">information relates is required, unless<\/p>\n\n\n\n<ol class=\"wp-block-list gtfy-130\" type=\\\"a\\\">\n<li class=\"gtfy-129 gutenify-list-item\">use or disclosure without consent is permitted under sections 7 to 7.4 of PIPEDA (PIPEDA S.7)<ol><li>it is impossible or impractical to seek consent, or<\/li><\/ol>\n<ol class=\"wp-block-list gtfy-128\">\n<li class=\"gtfy-127 gutenify-list-item\">the PI or PHI is not sensitive and the individual to whom the information relates would reasonably expect that consent is implied.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-133\"><a><\/a>Consent for collection, use, and disclosure of Personal or Personal Health Information.<\/h3>\n\n\n\n<p class=\"gtfy-136 wp-block-paragraph\">Where consent is required for the Collection, Use, or Disclosure of PI or PHI, that consent shall, either directly with NexgenRx or indirectly through transferred Plan Sponsor or Groups Consent Agreements<\/p>\n\n\n\n<ol class=\"wp-block-list gtfy-144\" type=\\\"1\\\">\n<li class=\"gtfy-139 gutenify-list-item\">be in writing or otherwise electronically or manually recorded,<\/li>\n\n\n\n<li class=\"gtfy-140 gutenify-list-item\">relate to the purpose for which the information is used or disclosed<\/li>\n\n\n\n<li class=\"gtfy-141 gutenify-list-item\">be knowledgeable, so that it is reasonable to expect that an individual to whom NexgenRx\u2019s activities are directed would understand the nature, purpose, and consequences of the collection, use, or disclosure of the PI or PHI to which they are consenting, including the implications of withdrawal of consent where applicable,<\/li>\n\n\n\n<li class=\"gtfy-142 gutenify-list-item\">be voluntary, and<\/li>\n\n\n\n<li class=\"gtfy-143 gutenify-list-item\">not be obtained through misrepresentation.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-147\"><a><\/a>Security of Personal or Personal Health Information<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-153\" type=\\\"1\\\">\n<li class=\"gtfy-150 gutenify-list-item\">NexgenRx shall implement reasonable administrative, physical, and technical security safeguards that ensure the confidentiality, security, accuracy, and Integrity of the PI or PHI in their custody or under their control and protect against risks such as unauthorized access, use, disclosure, or destruction.<\/li>\n\n\n\n<li class=\"gtfy-151 gutenify-list-item\">In determining the reasonableness of security safeguards, NexgenRx shall take into account the degree of sensitivity and medium of the PI or PHI to be protected.<\/li>\n\n\n\n<li class=\"gtfy-152 gutenify-list-item\">Reasonable safeguards shall, at a minimum, include the safeguards outlined in these procedures.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-156\">Security of Personal or Personal Health Information \u2013 Administrative Safeguards<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-161\" type=\\\"1\\\">\n<li class=\"gtfy-159 gutenify-list-item\">Only Authorized Persons may have access to PI or PHI.<\/li>\n\n\n\n<li class=\"gtfy-160 gutenify-list-item\">NexgenRx employees shall regularly attend privacy training offered by the company\u2019s Information and Privacy<\/li>\n<\/ol>\n\n\n\n<p class=\"gtfy-164 wp-block-paragraph\">Officer or complete other training as may be required by the company.<\/p>\n\n\n\n<ul class=\"wp-block-list gtfy-169\">\n<li class=\"gtfy-167 gutenify-list-item\">Authorized persons who may collect, use, disclose, store, or destroy PHI shall complete PHIA training and sign the PHIA Pledge of Confidentiality (see Appendix \u201cA\u201d attached).<\/li>\n\n\n\n<li class=\"gtfy-168 gutenify-list-item\">As may be required, specific, department-level policies and procedures regarding the collection, use, disclosure, and protection of PI or PHI according to its sensitivity, shall be implemented, and copies provided to the company\u2019s Information and Privacy Officer.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading gtfy-172\">Security of Personal or Personal Health Information \u2013 Personal Safeguards<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-182\" type=\\\"1\\\">\n<li class=\"gtfy-175 gutenify-list-item\">Physical access to PI or PHI shall be limited to authorized persons only.<\/li>\n\n\n\n<li class=\"gtfy-176 gutenify-list-item\">Authorized persons shall not discuss others\u2019 PI or PHI in the presence of those who are not authorized to know the information, and therefore shall not discuss others\u2019 PI or PHI in public, unsecured, or open places where those who are not authorized to know the information are likely to be or have access.<\/li>\n\n\n\n<li class=\"gtfy-177 gutenify-list-item\">Paper files and electronic devices and media containing PI or PHI shall be stored in a secured place at all times other than when being used as a necessary function of work.<\/li>\n\n\n\n<li class=\"gtfy-178 gutenify-list-item\">PI or PHI shall not be transported or otherwise removed from a secured place unless necessary.<\/li>\n\n\n\n<li class=\"gtfy-179 gutenify-list-item\">If transporting or otherwise removing PI or PHI from a secured place, only the minimum amount of information necessary may be transported and it must be secured in a briefcase or similar closed, opaque container and under the care and control of an authorized person.<\/li>\n\n\n\n<li class=\"gtfy-180 gutenify-list-item\">Whenever practicable, PI or PHI shall be de-identified before removing it from a secured place.<\/li>\n\n\n\n<li class=\"gtfy-181 gutenify-list-item\">PI or PHI should not be left unattended or unsecured in a vehicle.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list gtfy-186\">\n<li class=\"gtfy-185 gutenify-list-item\">Where file folders, records storage boxes, electronic devices and media, and other storage containers contain PI or PHI, labelling or other means of identification shall only reveal the minimum amount of information that is necessary for identification and use.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading gtfy-189\">Security of Personal Health Information \u2013 Technical Safeguards<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-200\" type=\\\"1\\\">\n<li class=\"gtfy-192 gutenify-list-item\">Access to PI or PHI maintained in electronic form shall be limited to authorized persons.<\/li>\n\n\n\n<li class=\"gtfy-193 gutenify-list-item\">Software, hardware, or operating system access controls such as strong passwords shall be used to prevent against unauthorized use, disclosure, or destruction of PI or PHI.<\/li>\n\n\n\n<li class=\"gtfy-194 gutenify-list-item\">Display screens shall be cleared without delay.<\/li>\n\n\n\n<li class=\"gtfy-195 gutenify-list-item\">Computers shall be logged off or shut down when not in use.<\/li>\n\n\n\n<li class=\"gtfy-196 gutenify-list-item\">If communicating PI or PHI through the mail or by fax, telephone, email, or social media, authorized persons shall consult the guidelines for the communication of personal and personal health information and take appropriate action.<\/li>\n\n\n\n<li class=\"gtfy-197 gutenify-list-item\">Password protection\/encryption shall be used if transporting PI or PHI on electronic devices and media.<\/li>\n\n\n\n<li class=\"gtfy-198 gutenify-list-item\">The use and disclosure of PI or PHI shall be audited and tracked within the resources available.<\/li>\n\n\n\n<li class=\"gtfy-199 gutenify-list-item\">When electronic devices and media are disposed of or used for another purpose, all PI or PHI shall be completely and effectively removed or destroyed by overwriting deleted information, reformatting the electronic storage medium, or physically destroying the electronic storage medium.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-203\">Security of Personal or Personal Health Information \u2013 Destruction<\/h3>\n\n\n\n<p class=\"gtfy-206 wp-block-paragraph\">PI or PHI shall be destroyed (within limits of contractual obligations) in a manner that takes into account the sensitivity of the information and protects the security, accuracy, integrity, and confidentiality of the individual\u2019s information, including at a minimum:<\/p>\n\n\n\n<ol class=\"wp-block-list gtfy-211\" type=\\\"1\\\">\n<li class=\"gtfy-209 gutenify-list-item\">shredding of all paper records, and<\/li>\n\n\n\n<li class=\"gtfy-210 gutenify-list-item\">effective and complete deletion of the information on all electronic devices and media.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-214\">Security of Personal or Personal Health Information \u2013 Shared Network Drives<\/h3>\n\n\n\n<p class=\"gtfy-217 wp-block-paragraph\">Where a department utilizes a shared network drive to maintain PI or PHI, NexgenRx shall:<\/p>\n\n\n\n<ol class=\"wp-block-list gtfy-223\" type=\\\"1\\\">\n<li class=\"gtfy-220 gutenify-list-item\">ensure that access to PI or PHI is restricted to authorized persons only<\/li>\n\n\n\n<li class=\"gtfy-221 gutenify-list-item\">maintain a record of the persons authorized to access PI or PHI, and<\/li>\n\n\n\n<li class=\"gtfy-222 gutenify-list-item\">regularly review the authorizations and update as required.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-226\"><a><\/a>Privacy Breaches<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-239\" type=\\\"1\\\">\n<li class=\"gtfy-229 gutenify-list-item\">Any complaint received about a privacy breach, or any knowledge of a privacy breach or a reasonable suspicion of a privacy breach, shall be immediately reported to the NexgenRx\u2019s Information and Privacy Officer.<\/li>\n\n\n\n<li class=\"gtfy-232 gutenify-list-item\">NexgenRx\u2019s Information and Privacy Officer shall determine whether the alleged privacy breach warrants investigation, taking into consideration:<ol><li>the length of time that has elapsed since the alleged privacy breach,<\/li><\/ol><ol><li>if the alleged privacy breach is trivial, or the complaint is otherwise not in good faith or frivolous, and<\/li><\/ol>\n<ol class=\"wp-block-list gtfy-231\">\n<li class=\"gtfy-230 gutenify-list-item\">if the circumstances of the alleged privacy breach warrant investigation.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li class=\"gtfy-235 gutenify-list-item\">If a privacy breach warranting investigation is confirmed as a privacy breach under FIPPA, PHIA or PIPEDA, NexgenRx\u2019s Information and Privacy Officer shall:<ol><li>take steps to contain the privacy breach, and<\/li><\/ol>\n<ol class=\"wp-block-list gtfy-234\">\n<li class=\"gtfy-233 gutenify-list-item\">implement corrective procedures to address the privacy breach and lessen the likelihood of future privacy breaches.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li class=\"gtfy-238 gutenify-list-item\">NexgenRx\u2019s Information and Privacy Officer shall generate a record of the privacy breach and the subsequent investigation and shall report the matter, as applicable, to:\n<ol class=\"wp-block-list gtfy-237\">\n<li class=\"gtfy-236 gutenify-list-item\">Information and Privacy Commissioner of Ontario (IPC), FIPPA, and<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list gtfy-243\">\n<li class=\"gtfy-242 gutenify-list-item\">in the case of serious privacy breaches or privacy breaches in the course of commercial activity, the Privacy Commissioner of Canada, or law enforcement agencies as may be appropriate.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading gtfy-246\"><a><\/a>Retention and Disposition of Personal or Personal Health Information<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-251\" type=\\\"1\\\">\n<li class=\"gtfy-249 gutenify-list-item\">PI or PHI used to make a decision that directly affects the individual to whom the information relates shall be retained for a reasonable period of time in accordance with all applicable legislation, regulation, and NexgenRx\u2019s Privacy policy.<\/li>\n\n\n\n<li class=\"gtfy-250 gutenify-list-item\">PI or PHI identified for destruction shall be destroyed in a manner that prevents unauthorized access, use, or disclosure, as set out in this policy.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-254\"><a><\/a>Research Involving Personal or personal health information<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-258\" type=\\\"1\\\">\n<li class=\"gtfy-257 gutenify-list-item\">No person shall collect, use, or disclose PI or PHI for research except as permitted by NexgenRx.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-261\"><a><\/a>Requests for Access to Personal Information<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-266\" type=\\\"1\\\">\n<li class=\"gtfy-264 gutenify-list-item\">Excepting only where there is an existing procedure for access to PI, individuals who wish to examine or receive a copy of their PI must submit a FIPPA request on the prescribed form (<a href=\\\"https:\/\/www.ipc.on.ca\/wp-content\/uploads\/2003\/08\/2021-request.pdf\\\">Request Form)<\/a> to NexgenRx\u2019s Information and Privacy Officer.<\/li>\n\n\n\n<li class=\"gtfy-265 gutenify-list-item\">Individuals who wish to examine or receive a copy of their PHI must submit a request to NexgenRx\u2019s Information<\/li>\n<\/ol>\n\n\n\n<p class=\"gtfy-269 wp-block-paragraph\">and Privacy Officer.<\/p>\n\n\n\n<ul class=\"wp-block-list gtfy-276\">\n<li class=\"gtfy-272 gutenify-list-item\">NexgenRx\u2019s Information and Privacy Officer shall make every reasonable effort to assist the individual making a request and to respond openly, accurately, completely and without delay.<\/li>\n\n\n\n<li class=\"gtfy-273 gutenify-list-item\">NexgenRx\u2019s Information and Privacy Officer shall respond within 30 days.<\/li>\n\n\n\n<li class=\"gtfy-274 gutenify-list-item\">If the time limit to respond to a request for access expires on a statutory holiday or a company closure day, the time limit is extended to the next business day.<\/li>\n\n\n\n<li class=\"gtfy-275 gutenify-list-item\">Prior to permitting an individual to examine or receive a copy of his or her PHI, NexgenRx\u2019s Information and Privacy<\/li>\n<\/ul>\n\n\n\n<p class=\"gtfy-279 wp-block-paragraph\">Officer shall confirm the identity of the requester.<\/p>\n\n\n\n<ul class=\"wp-block-list gtfy-285\">\n<li class=\"gtfy-282 gutenify-list-item\">On request, NexgenRx\u2019s Information and Privacy Officer shall provide the individual with an explanation of any term, code, or abbreviation used in the PHI.<\/li>\n\n\n\n<li class=\"gtfy-283 gutenify-list-item\">NexgenRx\u2019s Information and Privacy Officer is not required to permit an individual to view or copy his or her PHI.<\/li>\n\n\n\n<li class=\"gtfy-284 gutenify-list-item\">NexgenRx\u2019s Information and Privacy Officer who refuses to permit an individual to view or receive a copy of their PHI shall, to the extent possible, sever, redact or otherwise remove the PHI that cannot be released, permit the individual to view and receive a copy of the remainder of the information, and inform the individual of their right to complain to the Privacy Commissioner of Ontario about the refusal. (<a href=\\\"https:\/\/www.ipc.on.ca\/health-organizations\/access-and-correction\/\\\">IPC Access and Correction<\/a>)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading gtfy-288\"><a><\/a>Requests for Correction of Personal or Personal Health Information<\/h3>\n\n\n\n<p class=\"gtfy-291 wp-block-paragraph\">Individuals may submit a request for correction of PI or PHI in writing to the NexgenRx\u2019s Information and Privacy Officer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading gtfy-294\"><a><\/a>Exercising Rights of Another Person<\/h3>\n\n\n\n<p class=\"gtfy-297 wp-block-paragraph\">Any right or power conferred on an individual by this Policy may be exercised by another person pursuant to FIPPA <a href=\\\"https:\/\/www.ontario.ca\/laws\/statute\/90f31#BK112\\\">(FIPPA<\/a> <a href=\\\"https:\/\/www.ontario.ca\/laws\/statute\/90f31#BK112\\\">S.66)<\/a> or PHIA (<a href=\\\"https:\/\/www.ontario.ca\/laws\/statute\/04p03#BK38\\\">PHIA S.25 to 28<\/a>).<\/p>\n\n\n\n<h2 class=\"wp-block-heading gtfy-300\"><a><\/a>ADDITIONAL REQUIREMENTS IN RESPECT OF PERSONAL HEALTH INFORMATION<\/h2>\n\n\n\n<h3 class=\"wp-block-heading gtfy-303\"><a><\/a>Definitions:<\/h3>\n\n\n\n<p class=\"gtfy-306 wp-block-paragraph\"><strong><em>\u201cDemographic or Eligibility Information\u201d: <\/em><\/strong>PHI about an identifiable individual as defined in PHIA, including the<\/p>\n\n\n\n<p class=\"gtfy-309 wp-block-paragraph\">individual\u2019s:<\/p>\n\n\n\n<ul class=\"wp-block-list gtfy-326\">\n<li class=\"gtfy-312 gutenify-list-item\">name<\/li>\n\n\n\n<li class=\"gtfy-313 gutenify-list-item\">signature<\/li>\n\n\n\n<li class=\"gtfy-314 gutenify-list-item\">address<\/li>\n\n\n\n<li class=\"gtfy-315 gutenify-list-item\">email<\/li>\n\n\n\n<li class=\"gtfy-316 gutenify-list-item\">phone number<\/li>\n\n\n\n<li class=\"gtfy-317 gutenify-list-item\">sex<\/li>\n\n\n\n<li class=\"gtfy-318 gutenify-list-item\">date of birth<\/li>\n\n\n\n<li class=\"gtfy-319 gutenify-list-item\">date of death<\/li>\n\n\n\n<li class=\"gtfy-320 gutenify-list-item\">family associations<\/li>\n\n\n\n<li class=\"gtfy-321 gutenify-list-item\">eligibility for Health Care coverage<\/li>\n\n\n\n<li class=\"gtfy-322 gutenify-list-item\">jurisdiction of residence<\/li>\n\n\n\n<li class=\"gtfy-323 gutenify-list-item\">Personal Health Number (PHN)<\/li>\n\n\n\n<li class=\"gtfy-324 gutenify-list-item\">a unique identifier equivalent to the PHN assigned by another jurisdiction that pays for Health Care<\/li>\n\n\n\n<li class=\"gtfy-325 gutenify-list-item\">a unique identifier \u2013 not including a Social Insurance Number or, except as provided above, any other pre-existing identifier \u2013 assigned to an individual by a trustee for its own purposes.<\/li>\n<\/ul>\n\n\n\n<p class=\"gtfy-329 wp-block-paragraph\"><strong><em>\u201cElectronic Health Information System\u201d: <\/em><\/strong>a computer system or systems delegated to hosting PHI for access by authorized persons.<\/p>\n\n\n\n<p class=\"gtfy-332 wp-block-paragraph\"><strong><em>\u201cRecord of User Activity\u201d: <\/em><\/strong>a Record about access to PHI maintained on an electronic health information system, which identifies the following:<\/p>\n\n\n\n<ul class=\"wp-block-list gtfy-340\">\n<li class=\"gtfy-335 gutenify-list-item\">individuals whose PHI has been accessed<\/li>\n\n\n\n<li class=\"gtfy-336 gutenify-list-item\">persons who accessed PHI<\/li>\n\n\n\n<li class=\"gtfy-337 gutenify-list-item\">when PHI was accessed<\/li>\n\n\n\n<li class=\"gtfy-338 gutenify-list-item\">the electronic health information system or component of the system in which PHI was accessed, and<\/li>\n\n\n\n<li class=\"gtfy-339 gutenify-list-item\">whether PHI that has been accessed is subsequently disclosed<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading gtfy-343\"><a><\/a>Security of Personal Health Information \u2013 Electronic Health Information Systems<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-355\" type=\\\"1\\\">\n<li class=\"gtfy-348 gutenify-list-item\">Where an individual utilizes an electronic health information system to maintain PHI, NexgenRx shall:\n<ol class=\"wp-block-list gtfy-347\">\n<li class=\"gtfy-346 gutenify-list-item\">create and maintain, or have created and maintained, a record of user activity for at least three (3) years,<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li class=\"gtfy-349 gutenify-list-item\">A record of user activity may be generated manually or electronically.<\/li>\n\n\n\n<li class=\"gtfy-354 gutenify-list-item\">A record of user activity is not required:<ol><li>if the PHI is limited to, or qualifies or further describes, demographic or eligibility information, or<\/li><\/ol>\n<ol class=\"wp-block-list gtfy-353\">\n<li class=\"gtfy-352 gutenify-list-item\">if PHI is accessed or disclosed while an authorized person is generating, distributing, or receiving a statistical report, as long as NexgenRx:<ol><li>maintains a record of the persons authorized to generate, distribute, and receive such reports, and<\/li><\/ol>\n<ol class=\"wp-block-list gtfy-351\">\n<li class=\"gtfy-350 gutenify-list-item\">regularly reviews the authorizations.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading gtfy-358\"><a><\/a>Audit of Personal Health Information Security Safeguards<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-363\" type=\\\"1\\\">\n<li class=\"gtfy-361 gutenify-list-item\">NexgenRx shall conduct a review of administrative, physical, and technical security safeguards employed to protect PHI in the custody or under the control of the company at least every two years.<\/li>\n\n\n\n<li class=\"gtfy-362 gutenify-list-item\">If a review identifies deficiencies in NexgenRx\u2019s security safeguards, the company\u2019s Information and Privacy Officer<\/li>\n<\/ol>\n\n\n\n<p class=\"gtfy-366 wp-block-paragraph\">shall make recommendations to take steps to correct the deficiencies as soon as is practicable to do so.<\/p>\n\n\n\n<ul class=\"wp-block-list gtfy-370\">\n<li class=\"gtfy-369 gutenify-list-item\">NexgenRx\u2019s Information and Privacy Officer shall document the findings of the review along with any recommendations to monitor and ensure compliance under PHIA.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading gtfy-373\"><a><\/a>Notice of Right to Access Personal Health Information<\/h3>\n\n\n\n<ol class=\"wp-block-list gtfy-378\" type=\\\"1\\\">\n<li class=\"gtfy-376 gutenify-list-item\"><img width=\\\"2\\\" height=\\\"17\\\" src=\\\"\\\">Departments that retain PHI must use a sign, poster <a href=\\\"https:\/\/www.ipc.on.ca\/wp-content\/uploads\/2021\/10\/your-health-information-and-your-privacy-rights-poster.pdf\\\">(PHI Poster<\/a>), brochure, or other similar type of notice to inform individuals of their rights to examine and receive a copy of their PHI and to authorize another person to examine and receive a copy of the PHI subject to the right of the company to refuse as set out under PHIA <a href=\\\"https:\/\/www.ontario.ca\/laws\/statute\/04p03#BK85\\\">(PHIA<\/a> <a href=\\\"https:\/\/www.ontario.ca\/laws\/statute\/04p03#BK85\\\">S.54(1)(c)<\/a>).<\/li>\n\n\n\n<li class=\"gtfy-377 gutenify-list-item\">The sign, poster, brochure, or similar type of notice must be prominently displayed in as many locations and in such numbers as the company reasonably considers adequate to ensure that the information is likely to come to the individuals\u2019 attention.<\/li>\n<\/ol>\n\n\n\n<p class=\"gtfy-381 wp-block-paragraph\">These Procedures shall be reviewed in conjunction with the Privacy policy review at least once every five (5) years, or more frequently as required to reflect changes in legislation or to related company policies, procedures, and
